I. Introduction; Jurisdiction

This matter is before the court on defendant John Deere & Company’s (hereinafter “Deere”) motion for summary judgment, filed on March 13,1986 together with a supporting memorandum of law and several affidavits. On April 16, 1986, Deere filed a memorandum of supplemental authority.
