The motion for rehearing filed by appellant, Antonio J. Gutierrez, is denied. This court’s opinion and judgment dated April 7, 2004 are withdrawn, and this opinion and judgment are substituted. We substitute this opinion to clarify portions of our opinion and to clarify that the trial court denied the motion to strike the amended motion; however, our decision in this case is based on a ground raised in the original motion. For this reason, we do not ad dress the trial court’s ruling on the motion to strike.
