An infonnation drawn under R. S. 21-955 charged that on Sunday, June 22,- 1930, the defendant sold and exposed to sale goods, wares and merchandise by then and there selling to *854the public generally, for a valuable consideration, the privilege and right to attend and be entertained in a public movie and talkie show and theater at Mankato. Defendant’s motion to quash the information was overruled, whereupon he waived formal arraignment and trial by jury and pleaded not guilty.
