MEMORANDUM
MERHIGE, District Judge.
This matter is before the Court on Defendant’s motion for partial summary judgment, pursuant to Federal Rule of Civil Procedure 56. For the reasons which follow, the Court will grant the motion.

Plaintiff, a 67-year old American seaman, filed this action pursuant to the maritime laws of the United States, as amended by the Jones Act, 46 App.U.S.C. § 688 et seq.
