MEMORANDUM OPINION
MARK B. McFEELEY, Bankruptcy Judge.
This matter came before the Court on the defendant’s motion to dismiss. Two distinct issues are raised in the motion, one regarding the automatic stay and the other regarding the meaning of a transfer within 11 U.S.C. §§ 547 and 548. Due to the nature of the issues raised, the latter issue is properly brought as a motion to dismiss. The parties submitted stipulated facts for the purpose of the motion and thus the Court will consider the former issue as a motion for summary judgment.
