This is an action for damages for personal injuries received by plaintiff, a pedestrian, while crossing a street in the village of Ithaca, Michigan, when struck by an automobile owned and operated by defendant Donald W. Guild.
The accident occurred September 26, 1948, at about the hour of 10 p.m. On the above date, plaintiff operated a movie theater on the south side of Center street. This street is 64 feet wide from curb to curb and is the main business street of the village.
