Plaintiffs brought this action to recover damages for injuries to their property alleged to have been caused by the seepage of water from an irrigating ditch constructed, owned and operated by the defendants, and also to secure an injunction to restrain the defendants from maintaining and using their ditch in such a manner as to permit the waters flowing therein to. seep and percolate therefrom and cause injury and damage to the plaintiffs on said property.
