This is an application for a writ of prohibition to restrain the district court from further proceedings, and to vacate and annul an order made granting a new trial. The matter arose out of proceedings involving the dissolution of a partnership. On September 30, 1938, the district court made its findings of fact and conclusions of law in favor of plaintiff, who is the relator here. No judgment or decree was entered at that time, but subsequently, on November 22, 1938, a minute entry was made by the clerk which set forth that the judge of the district court informed him and ordered as follows:…
