This matter is before us on preliminary objections to a complaint in equity. Plaintiff avers that he is a real estate broker of the City of Philadelphia; that on or about October 22, 1951, defendant Stanley Kurcz in writing engaged plaintiff’s services as his exclusive agent to sell the restaurant business owned by Kurcz and all of its assets, including the liquor license and the real estate and building in which the business was conducted, known as 3965 North Third Street, Philadelphia, Kurcz agreeing to pay plaintiff a broker’s commission of $1,000.
