HERRMANN, Justice:

In this negligence action, the determinative question is whether violation of a State Board of Education regulation, governing the operation of school buses, constitutes negligence per se.

A Statute of this State, 14 Del.C. § 2901, 1 requires the State Board of Education, “by and with the advice of the Motor Vehicle Commissioner”, to “adopt and enforce regulations not inconsistent with the motor vehicle laws of this State to govern the * * * operation of all school busses used for the transportation of school children * *
