It appears from the record that appellee was the owner of the real estate described in the complaint, and that he executed a written lease of the same, to be used as an ice pond for a .period of ten years .from January 1, 1888, for $50 a year, to be paid the 1st day of July of each year, with the right, on the part of the lessee, to continue the same for an additional period of ten years on the same terms, with the exception that the rent for the second period of ten years was to be $150 a year, provided the lessor did not “discontinue the use of said real estate as a pond.” The lessee was…
