The plaintiff brought this bill in equity to restrain the City of Philadelphia, acting through its bureau and Board of Health “from trespassing on his property, and from seizing his hogs and destroying his pens, etc.,” pursuant to a notice that had. been served on him by the board of health, alleging that a nuisance existed on his property, consisting of “insanitary pig pens and surroundings, having a tendency to endanger and be prejudicial to public health,” and requiring him to abate the nuisance within ten days, etc. The case was heard on bill, answer, testimony and…
