This is an action, instituted after leave duly obtained, upon the official bond of the defendant Malberg as auditor of Marshall county, the other defendants being- bis sureties on the bond, and the appeal is from an order sustaining the general joint demurrer of the defendants to the complaint.
The bond here involved is in the usual form, conditioned that the defendant Malberg “shall well and faithfully discharge the duties of county auditor during bis continuance in office,” and the default alleged as constituting a breach of this condition consists of bis failure to give the statutory…
