MEMORANDUM AND ORDER

THEIS, District Judge.

This matter is before the court on cross motions for summary judgment. Defendant Department of Energy (DOE) has moved for summary judgment on its counterclaim against plaintiff Union Pacific Resources Company, -formerly Champlin Petroleum Company (UPRC). DOE requests that the court enter an order requiring UPRC to deposit into the escrow account established by the court the sum of $3,882,321 plus additional prejudgment interest accruing after December 31, 1993.
