MEMORANDUM OPINION
KESSLER, District Judge.
Plaintiffs are Walter J. Rosales and Karen Toggery. 1 Defendants are the United States of America, the U.S. Department of the Interior, the Bureau of Indian Affairs (“BIA” or “Bureau”), and the Interior Board of Indian Appeals (“IBIA” or “Board”).
