The plaintiffs in error are brothers, sisters, nieces and nephews of the testator. On the 19th day of June, 1895, the proponent (defendant herein) offered for probate in the county court of Douglas county an instrument purporting to be the last will of said George H. This is a petition in error to review^ a judgment of the district court of Douglas county, admitting to probate an instrument propounded as the last will and testament of George H. Boggs, deceased. A large number of exceptions were taken during the course of the trial, and numerous errors are assigned in this court. But the briefs and argument have been confined to the assignment that the verdict and judgment are contrary to the evidence, and to *278one based on an instruction given by the court on its own motion.
