Barnard, trustee in bankruptcy, had judgment against Sweet and MacFarland in a suit to recover for unpaid stock in The International Improvement Company. The case was reversed (Sweet v. Barnard, 66 Colo. 526, 182 Pac. 22), and a new trial granted. Upon the new trial the defendants were successful and plaintiff brings the case here for review.
