On February 6, 2013, Plaintiff filed its five-count Complaint against Defendant, alleging violations of anti-fraud and registration provisions of the Commodity Exchange Act (“CEA”) and CFTC Regulations. (“Complaint,” Dkt. No. 1.) On May 14, 2013, Defendant was indicted on criminal charges arising from the same fraudulent conduct described in the Complaint. See United States v.
