On February 9, 2011, the U.S. Commodity Futures Trading Commission (“Commission”) filed its Complaint [D.E. 2] in the above-captioned action against PMC Strategy, LLC (“PMC”) and Timothy Bailey (“Bailey”) (collectively “Defendants”)1 seeking injunctive and other equitable relief for violations of the Commodity Exchange Act (the “Act”), 7 U.S.C. §§ 1 et seq.
