Defendant, A. J. Zeigler, was charged jointly with his brother, Alvin Zeigler, with the crime of assault Avith intent to' kill, in Okfuskee county; was tried, convicted, and sentenced to serve a term of three years in the penitentiary, and has appealed.

Defendant cites three assignments of error.

First, that the court admitted incompetent, irrelevant, and immaterial evidence Avhich was prejudicial to the rights of the defendant.
