These two cases -vyere tried together in the District Court, and do not need separate attention here. They arise under the following circumstances:

In June, 1907, the plaintiff, who owned a large building in Wilkins-burg, Pa., insured it for $45,000 in several companies; each of the defendants writing a policy of $2,500. In March, 1908, á fire occurred, and much damage was done. A dispute arose immediately about the amount of the loss; the plaintiff asserting the damage to be nearly $35,000, and the defendants contending for a much lower sum. In such a situation,…
