OPINION AND ORDER

SCHEINDLIN, District Judge.

I. INTRODUCTION

On July 21, 2004, Michael Yannotti was charged with committing the following four crimes: (1) the substantive offense of en gaging in the affairs of the Gambino Organized Crime Family in violation of the Racketeering Influenced and Corrupt Organizations Act (“RICO”); (2) conspiring to participate in the affairs of the same enterprise; (3) murder of Robert Arena in aid of racketeering; and (4) murder of Thomas Maranga in aid of racketeering. 1
