The offense of which the defendant stands convicted is that of selling strong and spirituous liquors to be drunk upon the premises, without a license, in violation of section 31 of chapter 401 of the Laws of 1892. On the 28th day of January, 1895, one Leopold M. Starlc made a written order, upon a piece of paper, for five glasses of liquor, and delivered the same to the steward of the defendant, who filled the order from the stock of liquors belonging to'the club; and the same was served to Stark and his associates who drank it upon the premises.
