delivered the opinion of the court.
This is an appeal from an order of the circuit court of Winnebago county granting the plaintiff’s motion for a new trial. At the close of the plaintiff’s evidence, the defendant made a motion for a directed verdict which was granted. Under the instruction of the court, the jury returned a verdict finding the defendant not guilty.
