Finch, J.:

The notice to vacate the warrant of attachment was based on the grounds that the papers upon which the warrant was granted were, insufficient, in that the complaint submitted in support of the application for the warrant failed to state a cause of action; that there was a failure to show that the defendant was a foreign corporation, and failure to show facts sufficient to warrant the court in holding that the plaintiffs have been damaged in the sum claimed.
