HENDERSON”, Judge.
Appellant was convicted of the theft of two bales of cotton, over the value of $50, and his punishment assessed at two years confinement in the penitentiary.
The indictment is in two counts; the first of which charges that appellant, “did then and there unlawfully and fraudulently take two bales of lint cotton of the value of $70, the same being the corporeal personal property of Register Brothers, a mercantile firm composed of H.
