Defendant appeals from his convictions for robbery in the first degree, robbery in the second degree, three counts of burglary in the first degree, two counts of theft in the first degree, and kidnapping in the second degree. The convictions arose from a single episode in which the victim was kidnapped and robbed by a gunman during the course of a residential burglary committed by defendant and two other men. Defendant contends that the trial court erred in excluding hearsay declarations of one of the burglars that implicated the declarant, and not defendant, as the gunman. As a consequence,…
