This adversary proceeding is before the Court on Defendant PNC Mortgage, N.A.’s motion to dismiss the amended complaint filed by Plaintiffs Mathis and Lillian Richardson. (Doc. 23). The Plaintiffs object to the Defendant’s claim in their underlying bankruptcy, and have asserted claims for breach of contract, fraud, and violations of the Real Estate Settlement Procedures Act.
