Mr. Justice Drew,

This case arose out of the facts of a particularly sad and distressing accident. It is a combined action of a personal representative, Irwin Savings & Trust Company, brought to recover damages for the estates of four minor children of one family, ranging in age from about three to eight years, and also damages for their parents, because of the drowning of the children in a pool of water partly upon property of defendant and partly upon property of an adjacent owner, which had been formed by the diversion of the waters of a small stream by the failure of defendant to…
