Plaintiff sued defendant in the district court of Jefferson county, Tex., in the form of an action of trespass to try title for the recovery of lots 11 and 12 in block 77 of the city of Port Arthur, Tex. In the alternative, plaintiff sought to recover judgment for the balance of the principal, interest, and attorney’s fees due upon a vendor’s lien note originally for the sum of $4,150, given by defendant with the express vendor’s lien upon the above-described property to secure the…
