Reversing.
Tliis is an action in deceit for inducing appellee by false and fraudulent representations to enter into a written contract of insurance with appellant. The policy was dated June 18, 1894, and by its terms appellee’s life was insured for the sum of $3,000. The premiums were payable quarterly. For the first seven years of the policy, the insurance was designated as “Term Insurance,” and thereafter as “Assessment Insurance.” The premiums were regularly paid for a period of ten years extending to the year, 1904, when appellee…
