This case is here for the second time. Halstead v. Coen (1903), 31 Ind. App. 302. The issues then and now are the, same. After the return of this case to the Jasper Circuit Court the venue was changed to the Eewton Circuit Court, where the same was tried before the court without the intervention of a jury. The trial court submitted a special finding of facts, and stated its conclusions of law thereon.
