This matter is before the Court on the Defendant’s Motion to Dismiss or, Alternative, for Summary Judgment [ECF No. 5]. For the reasons discussed below, the motion will be granted.
I. BACKGROUND
The plaintiff brings this action under the Freedom of Information Act (“FOIA”), see 5 U.S.C. § 552, against the Federal Bureau of Prisons (“BOP”), a component of the United States Department of Justice (“DOJ”). 1 He alleges that, on or about July 18, 2014, he submitted a FOIA request to the BOP “seeking his chronological disciplinary record…
