HEFFERNAN, CHIEF JUSTICE

(dissenting). In

upholding Dwight and Patricia Norman's right to refuse to lease apartments to groups of unrelated persons, today's holding defies legal examination and legislative resolve alike. I thus reject the majority's reasoning and instead conclude that the Normans' actions are in violation of Chapter 31 of Dane county's fair housing ordinance which specifically forbids landlords to discriminate against persons on the basis of "marital status." Accordingly, I dissent from the majority's opinion.
