Appeal from special term, Monroe county. Action by Hiram Wood against Benjamin M. Baker and another. From a judgment directing a dismissal of the complaint, plaintiff appeals.

This action is brought to obtain an accounting of the rents and profits of certain real estate in the hands of the defendant, and for redemption of the land from an instrument which is claimed by the plaintiff to be a mortgage. The real estate involved consists of a lot on Fitzhugh street in the city of Rochester, with a 66-feet frontage, containing altogether about one-fourth of an acre. By an instrument dated January 9,1872, the plaintiff conveyed this land to the defendant Benjamin M. Baker for the consideration, as expressed in the deed, of the sum of $12,000.
