Darryl V. Nolan and his wife filed a personal injury action on July 21,2003, in Fulton County State Court against Clifton W. Jowers and Ryder TRS (“Ryder”), alleging that on July 20, 2001, Jowers negligently allowed his vehicle, owned by Ryder, to collide with a vehicle driven by Darryl Nolan, which caused Nolan personal and mental injuries and his wife the loss of his consortium.
