H. L. Barfield brought an action against the Georgia Southern & Florida Bailway Company, in a justice’s court, and obtained judgment for $57.89. The defendant company appealed to a jury in the superior court of Bibb county, where a ver: diet was rendered by the jury for the same amount as that of the judgment of the justice. The defendant moved for a new trial. The judge of the superior court overruled the motion, and thereupon the writ of error, which brings the case to our consideration, was sued out.
