MEMORANDUM OPINION

I. INTRODUCTION
Plaintiffs Bayer AG and Bayer Corporation filed this action on March 6, 2001 seeking a declaratory judgment that four patents assigned to defendant Housey Phannaceuticals, Inc. are invalid, unenforceable and not infringed. 1 (D.I.l) Defendant has filed a counterclaim of infringement. (D.I.5) The court has jurisdiction over this action pursuant to 28 U.S.C. §§ 1331, 1338(a) and 2201(a). Currently before the court are plaintiffs’ motion for summary judgment of unen-forceability of the patents in suit on grounds of misuse (D.I.190)…
