INTRODUCTION

Petitioner Photographic Illustrators Corporation ("PIC") initiated this action to confirm its arbitration award against Respondent OSRAM Sylvania, Inc. ("Sylvania"). As relevant here, the arbitrator ruled against PIC on its copyright infringement counterclaim and for PIC on its breach of contract counterclaim. He awarded PIC $ 9,591,049.99 in damages for the contract counterclaim.
