Before the Court is the Motion for Summary Judgment (the “Motion”) filed by The Guardian Life Insurance Company of America (“Guardian”) seeking a determi nation that five payments transferred from Lenox Healthcare, Inc. (the “Debtor”) to Guardian between April 19 and July 25, 2001, cannot be avoided and recovered by the Trustee pursuant to sections 547, 548, 549, and 550 of the Bankruptcy Code.
