Marilyn Lewis, a black woman with training in accounting and business administration, was terminated from her *405job as assistant fiscal director of the Trustees of Health and Hospitals of the City of Boston (TH&H) with one day’s notice. The alleged reasons for her discharge were corporate restructuring and an impending merger. A Superior Court judge affirmed a final administrative decision of the Massachusetts Commission Against Discrimination (MCAD), ruling that the termination was the product of unlawful racial discrimination in violation of G.
