Celtic Marine Corp. (“Celtic Marine”) filed suit against James C. Justice Companies, Inc. (“Justice”) in this maritime dispute for breach of contract. The parties reached two settlement agreements. The parties entered into the second agreement after the first was not fulfilled. After the second settlement agreement was also not timely fulfilled, Celtic Marine moved for summary judgment to enforce an acceleration clause, contained in the second settlement agreement, for all payments due under the first settlement agreement.
