This is an action to foreclose a mechanic’s lien based upon an express contract for leveling the defendants’ land. This is the second appearance of this case in this, court. See Knoell Constr. Co., Inc. v. Hanson, 205 Neb. 305, 287 N.W.2d 435 (1980). In that case this court af firmed the District Court finding that there was an express contract for the sum of $40,000, upon which $28,000 had been paid.
