Murphy delivered the opinion of the court:
The decree entered by the circuit court of Cook county in this case was reversed by the Appellate Court and the cause was remanded with directions to dismiss the complaint for want of equity. (311 Ill. App. 251.) This court granted leave to appeal.
In the summer of 1935 and for a long time prior thereto, plaintiff owned a two-apartment building located in Cicero. Except for some tax liens it was clear of encumbrances. Plaintiff’s daughter and her husband occupied the lower apartment and plaintiff made his home with them. Defendants and…
