The Chancellor.

By lease dated January 28, 1912, the defendant. leased to the complainant a lot of land and building on West Eleventh Street, in Wilmington, for five years at a money rent. The lessor agreed to make certain repairs and improvements theretofore agreed on, consisting of structural changes to adapt the building to the uses of the business of the complainant, and if they were not completed by February 1 the occupancy under the lease would begin upon their completion.
