MILLIKEN, Judge.

On the premise that no basic factual issue was developed by the recorded evidence before the Board, the trial court concluded that it was not bound by the refusal of the *141Workmen’s Compensation Board to grant an award to the dependents of Freddie Gene Clark for his death. Clark was killed by a pistol shot by a fellow employee, Howard West.
