Plaintiff, the People of the State of New York, move for summary judgment against defendant, Continental Casualty Company, in this action to recover on a bond issued by Continental. Continental’s codefendant, Condor of the Americas, Inc., procured a license from the Insurance Department of the State of New York, to act as an excess line insurance broker, and in its application named its president, Robert A.
