Plaintiff, Cecil Abel, commenced an action against Yalerie Bernhard McMahan to recover certain real property in Atherton in San Mateo County, which property, the plaintiff alleged, was conveyed to defendant as his performance under a partnership agreement. Plaintiff further alleged that since defendant had failed to perform her obligation to manufacture and distribute certain “soft” dolls and children’s books, said property was held in constructive trust for plaintiff.
