Cline, Judge:

This is a suit against the United States in which the plaintiffs protest against the assessment of duty on certain- dried huckleberries at the rate of 2% cents per pound under the provision for “Berries, edible, * * * dried” in paragraph 736 of the Tariff Act of 1930. In the protests filed with the collector the merchandise is claimed to be free of duty under either paragraph 1669 or paragraph 1722, but these claims do not appear to be relied upon by the plaintiffs. Amendments to the protests were granted by the court in which it is claimed that the commodity is free of duty…
