Reversing.
Anee Cornett was struck by a passenger train of the Louisville & Nashville Railroad Company and sustained fatal injuries. His administrator instituted an action against the railroad company to recover damages for his death. At the first trial of the action the circuit court directed a verdict for the defendant. The administrator prosecuted an appeal to this court, and the judgment was reversed. Cornett’s Adm’r v. L. & N. R. R. Co., 233 Ky. 797, 26 S. W. (2d) 1031.
